RULES
OF USE
(as of 7/19/02)
MEMBERSHIP RULES
Members are expected to follow the rules and guidelines outlined
below and as stated in the Terms and Conditions of their membership
as agreed by the Member upon enrollment. These Rules apply to all benefits
for which Members are entitled. Unless specified by Merchant, these
are the terms and conditions the members will be asked to agree to follow:
GENERAL TERMS
1) There is no limit to the number of times one can use their membership
benefits at each business prior to the memberships expiration
date. (Exception: Trial Use Memberships are only valid for the number
of visits indicated on the Trial Membership Card.)
2) Except for major holidays, there are no restrictions regarding the
days and times one can use their membership. Some businesses may honor
membership benefits on major holidays and for special events; we suggest
members call businesses first.
3) The membership benefits may not be combined with any other promotion,
discount or special offer, including: special sales, gift certificates,
previously discounted items, happy hour, early bird specials, and buffet
specials.
4) Members are asked to present their ClubAlliance membership cards before
ordering or making purchases.
5) Where tipping is appropriate, Members are reminded that a 15-20%
gratuity is customary and should be calculated on the pre-discounted
amount.
6) Membership is non-transferable.
7) If the Merchant's discount or benefit listing includes any specific
disclaimers, these disclaimers override any terms otherwise set forth
in this section.
8) Separate checks are discouraged. One bill per party please.
9) Restaurants may or may not honor the membership benefits on take-out
orders. Members are advised to check before ordering.
10) Large parties (10 or more) are encouraged to consult business prior
to use of membership privileges.
11) Membership does not guarantee admission where Member is underage
and age restriction is enforced.
12) Alcoholic beverages may be discounted only in states where permitted.
13) Please be patient with the staff at all participating businesses.
Your benefits are a Privilege, not a Right! New staff, change in management,
or new participants in the ClubAlliance program all deserve the opportunity
to become educated on their participation in the ClubAlliance program.
ClubAlliance will continually be contacting and educating all the participating
businesses in the ClubAlliance Benefits Network. However, please inform
ClubAlliance of any challenges you encounter (we like positive feedback,
too!). Please do not haggle with the business. This will help to serve
you and all other members better in the future. Keeping a printed copy
of the Benefits Directory with you is suggested.
14) Benefits are subject to change without notice.
15) Terms and Conditions are subject to change without notice.
16) Members are required to have fun. If fun does not occur, Membership
may be suspended unless Member seeks therapy! (were just kidding of
course)
TERMS
& CONDITIONS OF YOUR MEMBERSHIP
MEMBERSHIP
TERM
Except in the case of Trial Memberships or other special promotions,
memberships are valid for one year from the date of enrollment. However,
we might extend your membership a few months to adjust for any processing
lag time that might be experienced. In other words, if you enroll on
September 1 yet your membership is not mailed out to you until September
30, your membership will be valid for at least one year from September
30. This will be your "Anniversary Date". Your membership
card will be mailed to you and your "Anniversary Date" and
an explanation will be included at that time.
RENEWALS
Your membership will be valid through your Anniversary Date. It is recommended
that you apply for renewal several weeks
prior to this expiration date. An e-mail notification will be sent to
you as a reminder yet it is your responsibility to renew your membership
on time. You may at sometime in the future elect for the "auto-renewal"
option. This may be done by sending us an e-mail or by selecting that
option upon registration or renewal. Upon satisfying the requirements
of Membership renewal, you will receive a renewal sticker. Do not loose
or throw away your membership card when it expires otherwise you will
have nothing to put your renewal sticker on!
If you allow your membership to lapse, you may be required to join again
as a new member by paying the Enrollment Fee and the First Year's Dues
at the then current rate.
DUES
Your Dues are to be kept current in order to receive the membership
benefits offered within this program. Your Dues rate will remain the
same as the rate at which they were when you first enrolled so long
as you maintain current status. As stated above, should you allow your
membership to lapse, you may be required to join again as a new member
by paying the Enrollment Fee and the First Year's Dues at the then current
rate.
REPLACEMENT
CARDS
First rule, don't loose your membership card. Second, should you loose
your membership card, refer to the first rule! Okay, we know that eventually
you will be having just too much fun at a party and forget your membership
and perhaps even forget what bar you were at. But as long as you can
remember who you are, we can help you! You are entitled to one replacement
card per year. Replacement cards are $9.00. Your Anniversary Date will
not be changed nor your dues rate. If you loose your membership card
more than once a year, you might be required to attend shock therapy
sessions and take more ginkoboloba before we consider giving you another
card. Contact us to discuss your rehabilitation.
CITY
EXPANSION, PRICING & SCALING
As ClubAlliance expands into other cities, your membership is valid at
the businesses in that city as soon as their offer is posted on our
web site. As new cities are opened, we will offer Charter Memberships
for residents within that city. Membership pricing will eventually increase,
both the Enrollment Fee and the Dues, as more benefits are acquired
within a particular city. Therefore, pricing may be different from one
city to another. This does not mean, however, that you can buy a membership
in another city in order to save a few dollars. Pricing is based upon
the city where you enrolled for your membership.
TRIAL
USE MEMBERSHIPS
You lucky devils who get to try us out for free must remember that we
cannot keep offering you all these services and benefits if Membership
were always free. So, please be considerate and pay for a Membership
eventually! Trial Use Memberships are only released into new markets
or where market stimulation is required. They a not constantly available
and are reserved for your poor friends who do not yet have a membership
so they can check out what they've been missing. If you get a hold of
one, pass it along to someone who needs it. Make them remember you so
when they enroll, you'll get credit for the referral. We like referrals!
The Trial Membersips cannot be used to extend your current membership
and cannot be re-sold on the black market. Don't even think about it!
NEW
SERVICES
We intend to continually offer new benefits and services to our members.
Most of the new services will be available to Members at no extra charge.
However, some of the services may require membership upgrades or surcharges.
Don't whine if you have to pay to get something really cool for a few
more bucks. Obviously though, you will get the option. We will not stick
you with a bill for something unless we have your consent to stick it
to you.
CONDUCT
& REVOCATION
Membership is a privilege not a right. Don't act like a bonehead and
you'll be just fine. However, if the urge overwhelms you to be a bonehead,
we reserve the right to revoke your membership. As a matter of fact,
if you are an extreme bonehead, even one of the businesses within our
Benefits Network could take your membership and not return it to you.
If this happens, get the name of the place and the person that took
your card and contact us. We'll find out just how much of a bonehead
you were and decide what to do about you. Remember, we don't want to
look bad by having our members be boneheads. Otherwise, businesses won't
want to deal with us and then everyone looses. Things that constitute
boneheadedness: underage drinking, lewd and obnoxious conduct beyond
that which is just having fun, disrespect to staff or management at
any participating business, fighting and destruction of property, having
the police chase you through the bar, and so on. You get the idea, right?
REFUNDS,
UNSUBSCRIBE OR CANCELLATIONS
What, you don't like us anymore? Okay, it may happen that you'll have
your reasons for unsubscribing or canceling your membership. Well, send
us an e-mail: info@ClubAllianceCard.com.
State your case and we'll let you off the hook. However, there are no
refunds once your Membership Card has been sent to you. After that,
you can only request not to be billed for renewals.
